By placing an order and confirming payment on the website of Dane Care Ltd you are entering a legally binding contract in accordance with the following terms and conditions of sale. Terms and conditions are split into 3 sections: 1) those general to all sales, 2) those relevant for sales to private individuals, 3) those relevant for sales to trade customers.

New customers will be asked for their name and billing address being established as customers. By default, retail prices are charged to all new customers. If you consider you are eligible for trade prices or wish to be a reseller then contact Dane Care on 01952 727899 to have your pricing structure amended.

Delivery addresses can be amended as part of the order process.

When orders are taken verbally Dane Care will access the customer's account online and act as their proxy to complete the order. The breakdown of the cost of goods and transport will be given and an offer made to explain the general terms & conditions, which covers our returns policy, before payment is taken. An email confirming all details and a link to our terms & conditions will be sent immediately on the processing of payment. The customer takes full responsibility for checking these and raising any issues before shippment is made. If the customer wishes to check these details before making payment they should request a 'Pay on Account' sale to receive the email. Payment and shipment will only be processed after confirmation and payment details from the customer before the next working day's shipping deadline.

Thereafter, the order will be deleted and stock returned for general sale.

1. General terms and conditions

1.1. Goods

Goods must be used according to manufacturer's instructions on the product packaging. Wood is a natural product and the colour or density of surface an individual wood will vary by batch and age so sampling in advance of main works must be undertaken on every new project. It is very important to get a correct indication of how the final finish will appear and perform before committing on surfaces that can be expensive or impossible to rework. Specifications of the goods being sold may be altered as a result of our manufacturer's continuous efforts to improve product quality and performance so in the event of contradiction between product packaging and website instructions then customers must seeks clarification from Dane Care before proceeding with works. Dane Care will not be liable for any depreciation to a wood object’s value consequent to it being treated with products purchased from us. Dane Care will not be liable for any costs incurred for any work required to refinish surfaces or any costs for delays & disruption incurred during this process.

1.2. Samples

Due to the importance of sampling in advance of main works Dane Care is committed to keeping available samples of all products at cost prices. Most Woca products are available as branded items from the manufacturers’ own production. Ensure these are well mixed BEFORE opening, since pigments in our products invariably settle. When manufacturer’s samples are not available or out of stock then samples in our own packaging from Dane Care’s stock will be made available. These are 20ml size. We do everything possible to ensure they are fresh and well mixed. If a sample cannot be seen then contact Dane Care on 01952 727899 to enquire about availability. There are some items i.e. spray soap that cannot be made available as samples.

Remember samples can only give an indication of the final effect and colour that will be achieved. Primarily, this is because larger floor areas will be sanded differently and the application will also vary. Dane Care, therefore, will not accept responsibility for variations between colours achieved from sampling and actual projects.

1.3. Availability

Goods are available according to the stock quantities shown on line. When stock is shown as zero then this product will be on order. Please contact Dane Care on 01952 727899 to ask when restocking is likely. If for any reason an item is subsequently found to be out of stock when collating your order, then we will despatch an equal or greater quantity of the same product in an available canister size at no additional cost. Should this not be possible we will contact you to decide immediate action. We do not operate a back order system, therefore after two working days your order will automatically be cancelled and your payment refunded.

1.4. Prices

The price of the goods shall be the price listed on our website on the date of your order, exclusive of any VAT which may be payable by you. The price of goods inclusive of vat and transport will be shown before payment is taken. All prices displayed on the website are quoted in UK Pounds Sterling and must be paid in full, including delivery charges. All prices may vary. Customers and not Dane Care Ltd are responsible for any applicable customs duties or taxes in their own country.

1.5. Ordering

We will treat each order for goods, which is confirmed when you proceed from the relevant Payment screen, as an offer by you to purchase the goods and services subject to these terms and conditions. We shall supply you, subject to availability, with the quantity and specification of goods set out in your order. We shall confirm each order by email and such confirmation shall be our acceptance of the contract between us.

1.5. Payment

Payment may be made by any of the methods indicated on our website. Goods will not be shipped unless payment is received in full. Card details are passed to the SagePay Interface for processing. Payment is automatically authorised online and debited immediately.

1.6. Delivery

Delivery shall be made at the address specified by you at the time of ordering. We will make every effort to describe the delivery options correctly during the web ordering process and then ensure delivery within the times specified, but delivery times quoted are approximate only and we cannot be held responsible for any inconvenience arising from failure to provide the advertised service because of factors which could reasonably be considered to be outside our control. We strongly advise that you select the delivery option that suits your address and circumstances and that if the goods are required for a specific date they are ordered in advance to avoid any disappointment. Risk of damage or loss of the goods shall pass to you at the time of delivery to the specified delivery address. Delivery is complete when goods are signed for or left at the safe-point indicated by the customer as a safe place.

1.7. Choice of Law and Jurisdiction

These Terms shall be governed by and construed in accordance with UK Law. Dane Care Limited is a company registered in England and Wales under number 5735424 whose registered office is Dane Care Limited, Marsh Farmhouse, Barrow Road, Much Wenlock TF13 6PN. Vat reg. nr 879458158.

Nothing in these conditions will reduce your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights contact your local authority Trading Standards Department or Citizens’ Advice Bureau.

2. Terms and conditions specific for sales to private customers

2.1. Right to Cancel

Under the Distance Selling Regulations, you have a right to cancel your order for any item purchased on this website for a full refund of the value of goods exc. transport within 7 days from receiving the goods. Your right to cancel does not apply to items that have been opened, used or fitted by you. You must take reasonable care of the goods while they are in your possession. 2.2. Missing, Damaged or Defective Goods

If, in the unlikely event, your goods arrive and some are missing, or they are damaged condition or are defective or some are missing, you must inform us within 7 days stating the invoice number and the nature of the defect or shortage. Failure to do so will deem that you have accepted the goods.

2.3. Returns

The cost of returning cancelled goods will be borne by the customer and deducted from the refund due. The collection and return of goods will be arranged by Dane Care Ltd using their appointed courier service. This cost is the direct cost to Dane Care and is normally charged to us £5 higher than the original delivery price ie. c £15 for under 10kg. Variation results from different consignment weights. The cost of returning and replacing damaged or defective goods will be borne by Dane Care Ltd unless they are found to be in their correct condition in which case they will be treated as cancelled goods.

If for any reason a replacement is not available for a damaged or defective item then Dane Care Ltd will refund the value of the returned goods.

3. Terms and conditions specific for sales to business or sole traders

3.1. Right to Cancel
